Understanding DUI Laws in Tennessee
It is illegal to drive in Tennessee with a blood alcohol content (BAC) of .08 or greater. If your BAC is over the legal limit, you can be charged with DUI. This means that if the prosecution can show the test was accurate and the stop was lawful, you can be convicted of drunk driving, regardless of how well you may have been driving.
It is also illegal to drive while impaired by alcohol or drugs. If your breath or blood test is under the legal limit, or you refuse the test, you can still be charged with DWI/DUI if the state can show your ability to operate the vehicle was impaired due to alcohol or drugs.

There is no set BAC level for drugs. The state only needs to show the drugs impaired your ability to drive. The state will typically rely on evidence that shows impairment, including your manner of driving, results of field sobriety tests, such as walking a straight line, and your demeanor and appearance.
